Terms of Service

By accessing or using XolvedAI (“the Service”), operated at www.xolvedai.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service. XolvedAI is an adaptive intelligence platform built by Darell Anthony, shipping in production across education, brokerage operations, marketing intelligence, and Fair Housing compliance.

XolvedAI provides an AI-powered platform for marketing intelligence, adaptive learning, team collaboration, and professional operations that includes, but is not limited to:

• Conversational AI tutoring and adaptive learning powered by xAI Grok
• Marketing intelligence with trend radar, competitor tracking, and viral strategy
• Creative Agent Studio for AI image and video generation
• Team Inbox with shared email workspaces and Compliance Intelligence
• Re-Xolved brokerage operations (transaction management, commissions, Fair Housing compliance)
• Dynamic Notebook, Composer, and document management with semantic search
• Smart task management (AntiList) and energy-aware workspace tools
• Professional training, continuing education (CE) tracking, and certifications
• Telegram Mini App and bot integration
• Subscription-based access with Free, Starter, Business, Pro, and Enterprise tiers

You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Upload malicious files, viruses, or any harmful code
• Impersonate another person or entity
• Use the Service to harass, abuse, or harm others
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, architecture, prompts, model weights, training data, embeddings, or behavioral logic of any part of the Service
• Use automated systems (bots, scrapers, headless browsers, crawlers, RAG ingestion pipelines, evaluation harnesses) to access the Service except as expressly permitted in our use policy
• Train, fine-tune, distill, or otherwise create any AI model — pretraining, supervised fine-tuning, RLHF, DPO, evaluation datasets, model cards, “research” corpora — using content retrieved from xolvedai.com or any subdomain, regardless of authentication state
• Use content from the Service to inform a competitive product roadmap, replicate any feature (including but not limited to the Fair Housing Compliance Engine, curriculum content, Property Intelligence stack, AntiList task model, or Personal Intelligence framework), or create derivative marketing materials
• Retrieve more than 100 pages from xolvedai.com within any 24-hour window without a written license from [email protected]
• Bypass, circumvent, or attempt to circumvent any access control, rate limit, authentication mechanism, or robots.txt directive

This section is a binding contract term. By accessing any resource on xolvedai.com (including a single page, the sitemap, robots.txt, llms.txt, ai.txt, or any API endpoint), you (the operator of the automation) agree to it.

We log every request — IP address, user-agent, geographic origin, request path, referrer, browser fingerprint, request timing, and session sequence — to a tamper-evident audit table with date-partitioned preservation snapshots. The X-Robots-Tag: noai, noimageai header and <meta name="robots-ai" content="noai, noimageai"> tag are set on every response, constituting explicit machine-readable notice.

We will pursue remedies under (without limitation):

• 17 U.S.C. § 1201 (DMCA — circumvention of technological measures)
• 18 U.S.C. § 1030 (Computer Fraud and Abuse Act)
• State trade-secret statutes (including the New Mexico Uniform Trade Secrets Act, NMSA 57-3A)
• Federal copyright (17 U.S.C. § 501)
• Tortious interference and unjust enrichment
• Breach-of-contract (these Terms form a binding agreement under the well-established robots-exclusion-violation jurisprudence — see hiQ Labs v. LinkedIn, 9th Cir. 2022)

If you are conducting security research, academic study, or have a legitimate need to retrieve content at scale, contact [email protected]with the subject line “Research access request: [your org]” before any automated retrieval. We respond within 5 business days. Unauthorized automated access — regardless of intent — will be treated as a violation of these Terms and may trigger cease-and-desist action without further notice.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, AI models, system prompts, training corpora, the Fair Housing Compliance Engine database (Edition 2.0, May 2026, covering 9 federal statutes + 50 states + DC + 254 municipalities), the Personal Intelligence framework, the curriculum data (Cerrando Brechas, Building Bridges, AI Fluency Labs, Faith Path, Literacy Accelerator, Vida Práctica, Promise Seed), the Property Intelligence stack, and the AntiList task model — are the exclusive property of XolvedAI / Consulting x Darell Anthony and its licensors. Reproduction, distribution, modification, derivative works, AI training, model distillation, competitive ingestion, or any other use beyond personal access via the Service interface requires prior written consent. Content you upload remains your property, but you grant XolvedAI a limited license to process it for the purpose of providing the Service.

The presence of Allow: directives in our robots.txt grants crawl scope only. It does not grant a content-use license. Search-result snippeting with attribution and a visible link back to the canonical URL is permitted; everything else is governed by Sections 5 and 5A above and our published use policy.

The Service uses xAI Grok to generate responses, recommendations, marketing intelligence, compliance scans, and learning materials. AI-generated content is provided for informational and educational purposes only. XolvedAI does not guarantee the accuracy, completeness, or reliability of AI-generated content. You acknowledge that AI responses may contain errors and should be independently verified for critical decisions.

• Not legal advice: Fair Housing compliance tools, contract analysis, and Re-Xolved brokerage features are informational aids — not substitutes for licensed legal counsel.
• Not financial advice: Budgeting tools and commission calculations are estimates — consult a licensed financial advisor for financial decisions.
• Not accredited education: Curriculum content (Cerrando Brechas, AI Fluency Labs, etc.) is supplementary — XolvedAI is not an accredited educational institution.
• Real estate: Re-Xolved transaction management, commission calculations, and compliance tracking do not replace supervision by a Qualifying Broker or compliance with state licensing requirements.

The Service integrates with third-party platforms across the following categories: AI model providers (xAI / Grok), payment processing (Stripe), messaging (Telegram), e-signature workflows, transactional and marketing email delivery, application data and edge runtime infrastructure, error monitoring, and cloud hosting. A current list of named sub-processors is available on request. Your use of these integrations is subject to the respective third-party terms and privacy policies. XolvedAI is not responsible for the practices or content of third-party services.

Paid subscriptions (Starter, Business, Pro, Enterprise) are billed monthly or annually through Stripe. Free tier features are available without a subscription. Paid tiers include a 7-day free trial; no credit card is required to start. You may cancel at any time from your account settings — changes take effect at the end of the current billing period. Refunds are handled per Stripe’s refund policies. Each paid tier sponsors free student accounts through the Cerrando Brechas Impact Flywheel.

If your organization uses Team Inbox shared workspaces, inbound emails are processed by Grok to generate summaries, compliance scans, and suggested tasks. Email bodies are AES-256-GCM encrypted at rest. By enabling a shared inbox, the organization administrator consents to this processing on behalf of inbox members. Compliance Intelligence email scanning is opt-in per organization and can be disabled at any time.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described therein.

We strive to maintain the Service’s availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation.

To the fullest extent permitted by applicable law, XolvedAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid (if any) to use the Service in the 12 months preceding the claim.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. XolvedAI does not warrant that the Service will meet your requirements or expectations.

You agree to indemnify, defend, and hold harmless XolvedAI and its operators from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Santa Fe County, New Mexico.

We reserve the right to update these Terms at any time. Changes will be effective when posted to this page with an updated “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
