Terms of Service

By accessing or using XolvedAI (“the Service”), operated at xolvedai.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service. XolvedAI is an adaptive AI tutoring platform built by Consulting x D. Anthony.

XolvedAI provides an AI-powered platform for marketing intelligence, adaptive learning, team collaboration, and professional operations that includes, but is not limited to:

• Conversational AI tutoring and adaptive learning powered by xAI Grok
• Marketing intelligence with trend radar, competitor tracking, and viral strategy
• Creative Agent Studio for AI image and video generation
• Team Inbox with shared email workspaces and Compliance Intelligence
• Re-Xolved brokerage operations (transaction management, commissions, Fair Housing compliance)
• Dynamic Notebook, Composer, and document management with semantic search
• Smart task management (AntiList) and energy-aware workspace tools
• Professional training, continuing education (CE) tracking, and certifications
• Telegram Mini App and bot integration
• Subscription-based access with Free, Starter, Business, Pro, and Enterprise tiers

You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Upload malicious files, viruses, or any harmful code
• Impersonate another person or entity
• Use the Service to harass, abuse, or harm others
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service without permission

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and AI models — are the exclusive property of XolvedAI and its licensors. You may not reproduce, distribute, modify, or create derivative works without prior written consent. Content you upload remains your property, but you grant XolvedAI a limited license to process it for the purpose of providing the Service.

The Service uses xAI Grok to generate responses, recommendations, marketing intelligence, compliance scans, and learning materials. AI-generated content is provided for informational and educational purposes only. XolvedAI does not guarantee the accuracy, completeness, or reliability of AI-generated content. You acknowledge that AI responses may contain errors and should be independently verified for critical decisions.

• Not legal advice: Fair Housing compliance tools, contract analysis, and Re-Xolved brokerage features are informational aids — not substitutes for licensed legal counsel.
• Not financial advice: Budgeting tools and commission calculations are estimates — consult a licensed financial advisor for financial decisions.
• Not accredited education: Curriculum content (Cerrando Brechas, AI Fluency Labs, etc.) is supplementary — XolvedAI is not an accredited educational institution.
• Real estate: Re-Xolved transaction management, commission calculations, and compliance tracking do not replace supervision by a Qualifying Broker or compliance with state licensing requirements.

The Service integrates with third-party platforms including xAI (Grok), Stripe, Resend, Telegram, Documenso, Sentry, Supabase, and Vercel. Your use of these integrations is subject to the respective third-party terms and privacy policies. XolvedAI is not responsible for the practices or content of third-party services.

Paid subscriptions (Starter, Business, Pro, Enterprise) are billed monthly or annually through Stripe. Free tier features are available without a subscription. Paid tiers include a 7-day free trial; no credit card is required to start. You may cancel at any time from your account settings — changes take effect at the end of the current billing period. Refunds are handled per Stripe’s refund policies. Each paid tier sponsors free student accounts through the Cerrando Brechas Impact Flywheel.

If your organization uses Team Inbox shared workspaces, inbound emails are processed by Grok-4 to generate summaries, compliance scans, and suggested tasks. Email bodies are AES-256-GCM encrypted at rest. By enabling a shared inbox, the organization administrator consents to this processing on behalf of inbox members. Compliance Intelligence email scanning is opt-in per organization and can be disabled at any time.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described therein.

We strive to maintain the Service’s availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation.

To the fullest extent permitted by applicable law, XolvedAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid (if any) to use the Service in the 12 months preceding the claim.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. XolvedAI does not warrant that the Service will meet your requirements or expectations.

You agree to indemnify, defend, and hold harmless XolvedAI and its operators from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Santa Fe County, New Mexico.

We reserve the right to update these Terms at any time. Changes will be effective when posted to this page with an updated “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
